Corpus Christi police released Monday the affidavit detailing the arrests of 27-year-old David Lee Davila and 24-year-old Christina Trevino, both suspected in the 2015 murder of 13-year-old Alex Torres.
In an apartment complex on Treyway Lane, all of the doors look the same. According to the arrest affadavit, that is what confused Davila, who allegedly intended to shoot at apartment 79. Police said he accidentally shot at apartment 78, where Alex Torres had just opened the door.
According to the arrest affadavit, a witness came forward to police last week telling them that the homicide was supposed to be a retaliation against Davila's ex-girfriend after she reported them to Child Protective Services, who did interview Davila and Trevino two days before the shooting.
According to the document, Davila's ex-girlfriend lived in apartment 79 at the Treyway Apartments. Torres was at apartment 78, the wrong apartment.
Also according to the affidavit, a witness told police that a man sold Davila and Trevino a gun on the afternoon the day of the murder. That man was interviewed by police and said Davila claimed he needed the gun to threaten the mother of his child that lived at the Treyway Apartments. Davila gave the gun back after the murder and said he shot the wrong person.
Police would not comment on whether or not there are charges to come for the man who sold the gun because it is an open investigaton. They did say there are a lot of people involved in the case and so far only two have been arrested.
Police also would not disclose who the witness that came forward with the information is.
