CORPUS CHRISTI, Texas — An arrest report for 19-year-old Noah Acuna reveals why the report of an attempted home invasion led to his arrest and charges being raised against him for manslaughter and aggravated assault with a deadly weapon-family violence.
When Corpus Christi Police Department officers showed up in the 2000 block of Treyway Lane at about 8 p.m. Monday, they found a 22-year-old pregnant woman had been shot.
She originally told officers someone had broken into her home and shot her, but the arrest reveals that after questioning Acuna, her husband, that the story had been told didn't add up.
Police stated, in the report, that after originally questioning Acuna about the shooting, he told them his wife had accidentally shot herself in the leg. However, when confronted with the possibility of a gunshot residue swab, he admitted that it would reveal positive results because he had taken the gun from her after the shooting.
When police realized that the victim's unborn child had been pronounced dead at the hospital and the case became a death investigation.
Robbery/homicide detectives were called in to question Acuna, and it was only then that he admitted to being the shooter. But he said the incident had been accidental.
He told detectives that his wife was laying on the bed as he took the magazine out of a gun. After reinserting the magazine, he said he racked the gun's slide to "make sure" it was empty, and that's when the bullet fired.
The affidavit also states that he also was questioned after officers found 3D printing materials that led them to believe he was involved in manufacturing firearms and parts with the 3D printer.
The report doesn't state whether the gun used in the shooting was 3D printed, saying only that it was a 'functional' handgun.
He was arrested, and the report states that he has a previous active warrant for choking his wife and was being sought for that family violence/assault incident.
