Opening statements were heard Monday in the trial of Daniel Garcia, accused of shooting and killing 59-year old Benjamin Mustafa during an attempted armed robbery at Tim's Market.
Garcia is charged with capital murder and, if convicted, could face the death penalty.
In a confession tape to police, Garcia admitted to shooting Mustafa after attempting to rob Mustafa's convenience store last April, according to the district attorney. That store has since been renamed "Ben's Market" in his memory and has had two murals painted on the store walls to represent what Mustafa stood for.
Though the DA said Garcia did confess to police, he is still pleading not guilty.
