CORPUS CHRISTI, Texas — Eleazar Perez, accused of killing his 2-year-old son in July 2023, was in court Wednesday morning.
Police arrested him in Bishop over a year ago after his son was found unresponsive and not breathing at the family's home.
At the time, the Bishop police chief stated that there was enough evidence for the arrest.
On Wednesday, Perez's attorney, Hector Gonzalez filed a motion to quash the indictment, stating it was not specific enough to charge him with the murder of his son.
The court, however, disagreed saying it is sufficient under the Texas law.
"We're going to trial, and you know, have the jury decide someday whether my client did the commission of this offense, or he didn't," Gonzalez said.
The trial date is scheduled for some time next year.
